Representative John Curtis (R-UT) introduced the Star-Spangled Summit Act this week, a bill designed to allow the American flag to be flown on Kyhv Peak. For over 20 years, Robert Collins has seasonally placed an American flag on the peak above Provo, Utah. In 2021, Collins was informed by the Forest Service that placing the flag might violate agency policies. The proposed bill mandates that the Forest Service issue a special-use permit to ensure this local tradition continues.

"Utahns pride themselves on being the most patriotic people in the country and it is disappointing that federal policy would hamper such a wholesome local tradition," said Rep. Curtis. "Frustratingly, this is too often the case in Utah where nearly seventy percent of the land is federally managed. I am proud to recognize Robert’s patriotism and resolve this issue so Utahns can see the stars and stripes on the Peak once again."

For two decades, Collins has seasonally hoisted an American flag atop Kyhv Peak following snowmelt. A group ascends the trail to mount a temporary flagpole and conduct a ceremony honoring veterans and constitutional rights.

In 2021, Collins was informed that Forest Service policy prohibits constructing or maintaining any structure or improvement on National Forest System lands without special authorization.

In states with less federal land, decisions regarding small monuments like flags would typically be made by local governments representing community needs. However, in Western states with significant federal public land like Utah, federal legislation is often necessary for such unique decisions.

Key provisions of Curtis's bill include requiring the Forest Service to issue a special-use permit to Collins for placing and maintaining a flagpole bearing the U.S. flag, allowing regulations for proper care and maintenance of the flagpole, and permitting reissuance or termination of permits.
